Privacy Policy

  • Rationale

The Dante Alighieri Society requires information about students and their families in order to provide for the education of these students. It is important for DASWA to protect the information that they hold about their school community.

The Privacy Act 1988 & Privacy Amendment (Enhancing Privacy Protection) Act 2012 directs the manner in which private sector organisations manage the personal and sensitive information of individuals.

The purpose of the legislation is to ensure that organisations, which hold information about individuals, handle that information responsibly. It aims to establish a nationally consistent approach to the management of personal information.

This policy provides the principles and procedures to assist the School to comply with the relevant privacy legislation which will ensure that information held on students, staff, and parents maintains the privacy and dignity of all individuals.

  • Principles

The Australian Privacy Principles (APPs) outline the appropriate management and use of personal information by organisations. The thirteen APPs replace the previous National Privacy Principles (NPPs) and cover such matters as:

  1. Open and transparent management of personal information
  2. Anonymity and pseudonymity
  3. Collection of solicited personal information
  4. Dealing with unsolicited personal information
  5. Notification of the collection of personal information
  6. Use or disclosure of personal information
  7. Direct marketing
  8. Cross-border disclosure of personal information
  9. Adoption, use or disclosure of government related identifiers
  10. Quality of personal information
  11. Security of personal information
  12. Access to personal information
  13. Correction of personal information

2.1 DASWA shall endeavour to manage personal information in an open and transparent way.

2.2 DASWA will take such steps as are reasonable in the circumstances to implement practices, procedures and systems relating to the School’s functions or activities that:

  1. will ensure compliance with the APPs; and
  2. will enable the School to deal with inquiries or complaints about compliance with the APPs.

2.3  Only personal information that is reasonably necessary for DASWA’s functions or activities will be collected.

2.4  DASWA will obtain consent to collect sensitive information unless specified exemptions apply.

2.5  Only fair and lawful means will be used to collect personal information.

2.6  Personal information will be collected directly from an individual if it is reasonable and practicable to do so.

2.7  Where unsolicited personal information is received, it will be determine if it could have collected the information under APP 3 as if it had solicited the information. If so, APPs 5-13 will apply. If not, the information will be destroyed or de-identified.

2.8  At the time DASWA collects personal information (from the individual or from someone else) or as soon as practicable afterwards, steps will be taken (if any) as are reasonable in the circumstances to make an individual aware of:

  1. why the DASWA is collecting information about them;
  2. who else the DASWA might give it to; and
  • other specified matters.

2.9  DASWA will use or disclose personal information for the primary purpose of collection unless one of the exceptions in APP 6.2 applies (for example, for a related secondary purpose within the individual’s reasonable expectations, DASWA has consent or there are specified law enforcement or public health and public safety  circumstances).

2.10  Where the information is sensitive, the uses or disclosures allowed are more limited. A secondary purpose within reasonable expectations shall be directly related to the primary purpose of collection.

2.11   Personal information will not be used for direct marketing, unless one of the exceptions in APP 7 applies (for example, DASWA has obtained consent or where the individual has a reasonable expectation of their information being used or disclosed for that purpose and DASWA has provided a simple means for the individual to unsubscribe from such communications).

2.12   Before DASWA discloses personal information to an overseas recipient it shall take such steps as are reasonable in the circumstances to ensure that the recipient does not breach the APPs, unless an exception applies.

2.13   Government related identifiers shall not be adopted, used or disclosed unless one of the exceptions applies (eg. the use or disclosure is reasonably necessary to verify the identity of the individual for the purposes of DASWA’s functions or activities).

2.14   DASWA shall take such steps (if any) as are reasonable in the circumstances to ensure the personal information DASWA collects, uses or discloses is accurate, complete and up-to-date. This may require DASWA to correct the information and possibly advise organisations to whom it has disclosed the information of the correction.

2.15  DASWA shall take such steps as are reasonable in the circumstances to protect the personal information DASWA holds from misuse, interference and loss and from unauthorised access, modification or disclosure.

2.16   DASWA shall take such steps as are reasonable in the circumstances to destroy or permanently de-identify personal information no longer needed for any purpose for which DASWA may use or disclose the information.

2.17  If requested, DASWA shall give access to the personal information it holds about an individual unless particular circumstances apply that allow it to limit the extent to which it gives access.

In some cases where DASWA requests personal information about a student or Parent, if the information requested is not obtained, DASWA may not be able to enrol or continue the enrolment of the student or permit the student to take part in a particular activity.

Job applicants, staff members and contractors: In relation to personal information of job applicants, staff members and contractors, DASWA’s primary purpose of collection is to assess and (if successful) to engage the applicant, staff member or contractor, as the case may be.

Sensitive information will be used and disclosed only for the purpose for which it was provided or a directly related secondary purpose, unless you agree otherwise, or the use or disclosure of the sensitive information is allowed by law.

3.5 Management and security of personal information by DASWA.

DASWA committee, volunteers, contractors and staff are required to respect the confidentiality of students’ and Parents’ personal information and the privacy of individuals.

DASWA has in place steps to protect the personal information the school holds from misuse, interference and loss, unauthorised access, modification or disclosure by use of various methods including locked storage of paper records and password access rights to computerised records.

3.6 Access and correction of personal information.

Under the Commonwealth Privacy Act, an individual has the right to obtain access to any personal information that DASWA has about them and to advise DASWA of any perceived inaccuracy. There are some exceptions to this right set out in the Act. Students will generally be able to access and update their personal information through their Parents, but older students may seek access and correction themselves.

There are some exceptions to these rights set out in the applicable legislation.

To make a request to access or update any personal information DASWA holds about an individual or student, individuals must contact the school coordinator in writing.

DASSWA may require individuals to verify their identity and specify what information is required.

3.7 Consent and rights of access to the personal information of students.

For students under 18, DASWA refer requests for consent and notices in relation to the personal information of a student to the student’s Parents. DASWA will treat consent given by Parents as consent given on behalf of the student, and notice to Parents will act as notice given to the student.
